In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 We, us, our means Rubbish Removal Watford, the provider of rubbish removal and waste collection services.

1.2 You, your means the customer, whether an individual, business, landlord, managing agent, or any other party requesting our services.

1.4 Premises means the property, land, building, or area from which waste is to be collected or where services are to be performed.

1.5 Waste means any items, materials, rubbish, junk, debris, or other refuse that you ask us to remove, and that we agree is suitable for collection and disposal under these Terms and Conditions.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services for domestic and commercial customers. This may include one-off collections, scheduled clearances, and ad hoc waste removal within our service area.

2.2 We reserve the right to refuse to remove any items that we reasonably consider: to be hazardous or dangerous; to require specialist handling or permits; to be prohibited by law; or to be outside the scope of what we have agreed with you at the time of booking.

2.3 We do not provide demolition, structural alteration, plumbing, electrical, or other specialist trades services unless explicitly agreed in writing.

2.4 All services are subject to availability. We do not guarantee that a particular date or time slot will be available until we confirm your booking.

3. Booking Process

3.1 You may request a quotation or make a booking by telephone, email, online form, or any other method we make available.

3.2 When requesting a quotation, you must provide accurate and complete information about:

a. The type and approximate volume or weight of waste to be collected.

b. The location and access to the premises, including floors, stairs, parking, and any restrictions.

c. Any items that may require special handling.

3.3 Any quotation we provide prior to arrival is an estimate only and is not binding. The final price will be confirmed on site once our operatives have inspected the waste and access conditions.

3.4 A booking is only confirmed when we have accepted your request and provided you with a confirmation by telephone, email, or message.

3.5 You must ensure that you or an authorised representative is present at the premises at the agreed time to grant access, confirm the waste to be removed, and approve any final price before work begins.

4. Pricing and Payment

4.1 Our charges are generally based on the volume, weight, and type of waste, as well as the time required, access conditions, labour involved, and any disposal fees.

4.2 Prices are quoted in pounds sterling and, where applicable, are inclusive of any VAT or other taxes that may apply, unless we indicate otherwise.

4.3 We will confirm the final price on site before commencing the work. By allowing us to start the service, you are deemed to have accepted the quoted price.

4.4 Unless otherwise agreed in writing, payment is due immediately on completion of the service. We may accept various payment methods such as cash, card, or bank transfer, subject to availability at the time of service.

4.5 For commercial customers, account facilities or alternative payment terms may be agreed in advance at our sole discretion. Where such terms are agreed, payment must be made in accordance with the agreed schedule. We reserve the right to charge interest on overdue amounts at the maximum rate permitted by law.

4.6 If we incur additional costs as a result of inaccurate information provided by you, access delays, waiting time beyond a reasonable period, or additional waste not disclosed at the time of booking, we may apply additional charges which will be explained to you before or as soon as reasonably practicable.

5. Cancellations and Amendments

5.1 You may cancel or amend your booking by contacting us as soon as possible using the same method you used to make the booking or any other contact details we provide.

5.2 If you cancel more than 24 hours before the agreed arrival time, no cancellation fee will normally be payable, unless we have incurred specific costs related to your booking which we will notify you about.

5.3 If you cancel less than 24 hours before the agreed arrival time, or if we are unable to carry out the service because you or your representative are not present, access is not available, or the waste is significantly different from what was described, we may charge a cancellation fee or a call-out fee to cover our costs.

5.4 We reserve the right to cancel or reschedule a booking in the event of circumstances beyond our reasonable control, including but not limited to vehicle breakdown, severe weather, accidents, illness, or issues affecting access to the premises. In such cases, we will endeavour to provide as much notice as possible and arrange an alternative time.

6. Access and Parking

6.1 You are responsible for ensuring that reasonable access to the premises is available at the agreed time. This includes arranging parking or permits where required, ensuring doors, gates, or communal areas are unlocked, and providing clear access routes where possible.

6.2 If suitable parking is not available and we incur parking charges or penalties directly related to providing the service, we may add these costs to your invoice and you agree to reimburse us in full.

6.3 If we are unable to perform the services safely due to restricted access, unsafe conditions, or other hazards, we may refuse to proceed or may require additional charges for extra labour or time. Any such decision will be made at our reasonable discretion.

7. Waste Regulations and Prohibited Items

7.1 We operate in accordance with applicable UK waste management laws and regulations. We will transport and dispose of waste only at authorised facilities and in compliance with our legal obligations.

7.2 You confirm that you have the lawful right to transfer the waste to us for removal. You must not request removal of any items that you are not entitled to dispose of, including stolen or illegally obtained goods.

7.3 We do not normally accept or remove hazardous or specialist waste, including but not limited to: asbestos, chemicals, solvents, oils, paint in liquid form, medical waste, clinical waste, gas bottles, pressurised containers, explosives, and certain electrical equipment requiring special treatment. If such items are found among the waste, we may refuse to remove them and may charge for any time or costs incurred.

7.4 Where we agree in advance to remove any items that are subject to specific regulations or require additional permits, this will be clearly confirmed and may attract additional charges.

7.5 Once we have removed the waste from your premises and it has been loaded onto our vehicle, the waste becomes our responsibility. We will handle the transportation, transfer, and disposal in compliance with all relevant legislation.

8. Customer Obligations

8.1 You must ensure that the waste to be removed is clearly identified and separated where necessary. If you require only certain items to be taken, you must specify this clearly to the operatives on arrival.

8.2 You must inform us of any items that may present a risk, including sharp objects, broken glass, or heavy or awkward loads, so that we can take appropriate precautions.

8.3 You are responsible for ensuring that children, pets, and other occupants are kept at a safe distance while our operatives are working.

8.4 You must not ask our staff to undertake tasks outside the agreed scope of services or that could put them at risk, including unsafe lifting, climbing, or work at height without proper equipment.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing our services. However, you acknowledge that the nature of rubbish removal and waste clearance may involve movement of items in confined or cluttered areas, and some risk of incidental damage cannot be entirely eliminated.

9.2 We will not be liable for any pre-existing damage to your property, fixtures, fittings, or belongings, or for any damage that results from inherent defects, poor installation, or wear and tear.

9.3 Our liability for any loss or damage arising out of or in connection with the services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific service giving rise to the claim, except where such limitation is not permitted by law.

9.4 We shall not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, loss of data, or loss of opportunity.

9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which exclusion or limitation of liability is not permitted by law.

10. Complaints

10.1 If you are dissatisfied with any aspect of our service, you should notify us as soon as possible, and in any event within a reasonable period after the service has been completed.

10.2 We may ask you to provide details of your complaint, including photographs or other evidence, so that we can investigate and respond.

10.3 We will endeavour to resolve complaints fairly and promptly. Remedies may include a partial refund, a price adjustment, or in some cases a return visit, at our discretion and subject to the circumstances.

11. Data Protection and Privacy

11.1 We may collect and process personal data about you for the purposes of managing bookings, providing services, processing payments, and maintaining records.

11.2 We will handle personal data in accordance with applicable data protection laws and will take reasonable steps to keep such information secure.

11.3 By using our services, you consent to the use of your personal data for these purposes. You may contact us to request access to, or correction of, the personal data we hold about you, subject to legal requirements.

12. Intellectual Property

12.1 Any content, materials, branding, or documentation that we provide in connection with our services are and remain our property or that of our licensors.

12.2 You may not reproduce, copy, or use such materials for any purpose other than as necessary for using our services in accordance with these Terms and Conditions.

13. Changes to These Terms

13.1 We may update or amend these Terms and Conditions from time to time. The revised version will apply to all bookings made after the date on which the updated terms are published or otherwise made available.

13.2 It is your responsibility to review the Terms and Conditions at the time of booking. Continued use of our services after any changes are implemented constitutes your acceptance of the updated terms.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of services.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

15.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitably qualified provider, provided that this does not materially affect your rights under these Terms and Conditions.

15.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of rubbish removal and waste collection services and supersede any prior understandings, representations, or agreements, whether oral or written.

By making a booking with Rubbish Removal Watford, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
